حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، ‏‏‏‏‏‏حَدَّثَنَا يَعْقُوبُ يَعْنِي الْإِسْكَنْدَرَانِيَّ الْقَارِيَّ، ‏‏‏‏‏‏عَنْ عَمْرٍو، ‏‏‏‏‏‏عَنْ الْمُطَّلِبِ، ‏‏‏‏‏‏عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ صَيْدُ الْبَرِّ لَكُمْ حَلَالٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَدْ لَكُمْ . قَالَ أَبُو دَاوُد:‏‏‏‏ إِذَا تَنَازَعَ الْخَبَرَانِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُنْظَرُ بِمَا أَخَذَ بِهِ أَصْحَابُهُ.

I heard the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم say: The game of the land is lawful for you (when you are wearing ihram) as long as you do not hunt it or have it hunted on your behalf. Abu Dawud said: When two traditions from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم conflict, one should see which of them was followed by his Companions.
